Direct Sales, Warranty & Returns Policy
Effective Date: 25 September 2026
Last Updated: 25 September 2026
This Policy explains the terms that apply to eligible devices and equipment sold directly by Eco Tech Recycle outside third-party marketplace processes.
It covers direct sales, product descriptions, used and refurbished equipment, our voluntary 30-Day Eco Tech Functional Warranty, consumer statutory rights, returns, distance-sales cancellation rights and refunds.
Eco Tech Recycle is a trading name of Tech Cell Limited.
Nothing in this Policy limits or excludes any consumer rights that cannot lawfully be limited or excluded.
Key Points at a Glance
This Policy applies to direct sales by Eco Tech Recycle outside third-party marketplaces such as eBay.
Many devices we sell are used, refurbished, repaired or second-hand.
Material known faults should be disclosed before sale.
Eligible Retail Ready devices may include our voluntary 30-Day Eco Tech Functional Warranty.
The Eco Tech warranty is additional to statutory consumer rights and does not replace or restrict them.
Consumer goods must meet applicable legal requirements, including requirements concerning satisfactory quality, fitness for purpose and description.
Consumers buying eligible goods at distance will normally have statutory cancellation rights, subject to applicable exceptions.
Change-of-mind rights for an in-person purchase are different from rights relating to faulty or misdescribed goods.
Returns should be made without adding new locks, damage or missing components.
Different terms may apply to genuine business-to-business transactions.
1. Scope
This Policy applies to devices or equipment owned and sold directly by Eco Tech Recycle through routes including:
direct invoice;
in-person sale;
email;
telephone;
WhatsApp;
direct website enquiry;
direct delivery; or
another direct non-marketplace sales route.
It may apply to sales to:
individual consumers;
businesses;
schools;
charities;
community organisations; and
other organisations.
Different legal rights may apply depending on whether the purchaser is acting as a consumer or in the course of business.
2. Marketplace Sales
This Policy does not govern transactions completed through an independent marketplace where that transaction is subject to the marketplace’s applicable transaction, return and buyer-protection processes.
For example, eBay transactions may also be subject to:
the applicable eBay listing;
eBay returns processes;
eBay Money Back Guarantee or other applicable buyer-protection processes; and
relevant eBay terms and policies.
Any statutory rights that apply remain unaffected.
3. Customer-Owned Repair Devices
This Policy does not apply to a customer’s own device where Eco Tech Recycle is carrying out a repair or refurbishment service and returning the same device to that customer.
Those services are covered by our applicable Repair, Refurbishment & Returned Device Service Policy and any specific repair quotation or agreement.
4. Product Information
Before a direct sale is completed, we aim to provide material product information appropriate to the transaction.
Depending on the equipment, this may include:
device type;
manufacturer;
model;
specification;
storage capacity;
RAM;
processor;
serial number or IMEI where appropriate;
cosmetic grade;
functional condition;
material known faults;
display condition;
battery information where specifically tested or stated;
included accessories;
missing accessories;
relevant repair or refurbishment information;
price;
applicable warranty information; and
collection or delivery arrangements.
Customers should review the product information before completing a purchase and ask us about anything that is unclear.
5. Used, Refurbished and Second-Hand Equipment
Many products sold by Eco Tech Recycle are:
used;
refurbished;
repaired;
recovered;
ex-business;
ex-school;
ex-organisation; or
otherwise second-hand.
Such equipment may show signs of previous use.
Examples may include:
scratches;
scuffs;
dents;
casing wear;
keyboard wear;
battery wear; or
other cosmetic signs consistent with previous use.
Used or refurbished equipment should not be understood to be new unless it is expressly described as new.
The age, description, price and disclosed condition of used equipment may be relevant when considering what quality can reasonably be expected. Under the Consumer Rights Act, satisfactory quality is assessed in light of the description, price and other relevant circumstances. Legislation.gov.uk
6. Device Grading
Where applicable, devices may be classified in accordance with our Device Grading, Functional Condition & Resale Classification Policy.
A cosmetic grade does not, by itself, confirm functionality.
Similarly, a functional classification does not mean that a device is cosmetically new.
Material information contained in the actual sales description takes priority over assumptions based solely on a grade.
7. Consumer Statutory Rights
Where a customer purchases as a consumer, applicable statutory consumer rights apply.
Under the Consumer Rights Act 2015, goods supplied to consumers are subject to statutory requirements including that they must be:
of satisfactory quality;
fit for a particular purpose where the applicable legal requirements are met; and
as described.
These rights cannot be removed simply by describing equipment as used, refurbished or second-hand. However, the age, price, description, disclosed faults and other relevant circumstances may affect what a reasonable person would regard as satisfactory quality. GOV.UK
A customer does not normally have a remedy for a particular fault merely because it exists if that specific fault was clearly brought to the customer’s attention before the contract in circumstances recognised by applicable law.
Nothing in our warranty or this Policy excludes rights that cannot lawfully be excluded.
8. 30-Day Eco Tech Functional Warranty
Eligible Eco Tech-owned direct-sale devices may include our voluntary:
30-Day Eco Tech Functional Warranty
Where included, this warranty covers eligible material functional faults that:
were not disclosed before sale;
arise during normal intended use; and
are reported within 30 days of the relevant sale or delivery date.
The warranty applies only where it is stated or confirmed as included with the particular sale.
The 30-Day Eco Tech Functional Warranty is additional to statutory consumer rights.
Expiry of the 30-day warranty does not mean that any statutory rights that continue to apply have expired.
9. Devices Eligible for the Eco Tech Warranty
Unless otherwise expressly agreed, the Eco Tech Functional Warranty is intended primarily for eligible direct-sale equipment that has been classified as suitable for retail sale.
Eligibility may depend on:
device type;
condition;
sales route;
functional classification;
disclosed faults;
intended use; and
the terms stated on the invoice, receipt, quotation or sales description.
Trade, wholesale, parts-only, spares-or-repair or specifically excluded equipment may be subject to different written terms.
Any such terms remain subject to applicable law.
10. What the Voluntary Warranty Does Not Normally Cover
Unless specifically agreed otherwise, the voluntary Eco Tech Functional Warranty does not normally cover problems caused after sale by:
accidental damage;
impact damage;
liquid damage;
misuse;
neglect;
inappropriate storage;
unauthorised modification;
damage caused by third-party repair or modification;
customer-caused software changes;
malware or software installed after sale;
passwords or account locks added after sale;
MDM or organisational management added after sale;
data loss;
damage during customer-arranged transport;
use outside the device’s normal intended purpose; or
failure to follow reasonable usage or safety instructions.
It also does not normally cover:
cosmetic wear already disclosed before sale;
a specific functional fault clearly disclosed before sale;
normal deterioration of consumable components; or
accessories not included in the sale.
These exclusions relate to our voluntary warranty only. They do not exclude statutory rights where those rights apply.
11. Battery Condition
Batteries are consumable components and naturally deteriorate with age and use.
Unless a particular battery-health level, capacity or runtime is expressly stated as part of the sale, the general device grade should not be interpreted as a guarantee of a specific battery capacity or operating duration.
However, this does not exclude statutory consumer rights relating to the condition, description or quality of the goods.
If a material battery fault existed at the relevant time and the customer’s statutory rights apply, those rights remain unaffected.
12. Making a Warranty or Fault Claim
If you believe a direct-sale device has developed a fault, contact:
info@ecotechrecycle.co.uk
Please provide, where available:
your name;
invoice, receipt or order reference;
device model;
serial number or IMEI;
description of the problem;
date the problem first appeared;
relevant photographs or video; and
any relevant error messages.
Please do not send passwords, PINs or authentication codes.
13. Inspection of Returned Equipment
We may need to inspect or test a device before determining the appropriate response.
Assessment may consider:
the reported fault;
device condition;
diagnostic results;
signs of accidental damage;
liquid damage;
unauthorised modification;
missing components;
security locks;
previous disclosed faults; and
other relevant evidence.
Any inspection requirement will be applied consistently with the customer’s applicable statutory rights.
14. Consumer Remedies for Faulty Goods
The voluntary Eco Tech warranty does not replace the remedies available under applicable consumer law.
Depending on the circumstances, statutory remedies may include:
short-term right to reject;
repair;
replacement;
price reduction; or
final right to reject.
Under the Consumer Rights Act 2015, the ordinary time limit for the short-term right to reject is 30 days, subject to the Act’s conditions and exceptions. The legislation also provides for repair/replacement and, in appropriate circumstances, price reduction or final rejection. Legislation.gov.uk
The appropriate remedy depends on the circumstances and applicable law.
15. In-Person Purchases and Change of Mind
Where a customer purchases goods in person and simply changes their mind, there is generally no automatic statutory right to a refund solely because they no longer want the item.
Eco Tech Recycle may choose to accept a change-of-mind return in an individual case, but unless expressly agreed this is discretionary for an ordinary in-person purchase.
This does not affect rights where goods are faulty, misdescribed or otherwise fail to meet applicable statutory requirements. GOV.UK guidance confirms that a trader does not generally have to refund an in-person customer simply because they no longer want the item, while faulty or misdescribed goods are treated differently. GOV.UK
16. Distance Sales to Consumers
A direct sale may be a distance contract where it is concluded with a consumer without the simultaneous physical presence of Eco Tech Recycle and the consumer, under an organised distance-sales arrangement.
Examples may include qualifying transactions completed by:
telephone;
email;
WhatsApp;
website; or
another qualifying remote communication method.
Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, Eco Tech Recycle will provide the information required for the relevant transaction.
For most qualifying distance sales of goods, a consumer has a statutory right to cancel without giving a reason during the applicable cancellation period, subject to legal exceptions. GOV.UK states that consumers must generally be told they can cancel up to 14 days after the goods are delivered. GOV.UK
17. Distance-Sale Information
Where legally required, before a qualifying distance-sale order is completed we will provide information appropriate to the transaction, which may include:
our business identity;
contact details;
business address;
main characteristics of the goods;
total price including applicable taxes;
delivery charges;
payment arrangements;
delivery arrangements;
applicable cancellation rights;
return-cost responsibility;
complaints information;
applicable warranty or after-sales information; and
other information required by law.
For qualifying distance contracts, required contractual information must also be provided in a durable medium where the law requires it. GOV.UK identifies these pre-contract and confirmation requirements for distance sales. GOV.UK
18. Distance-Sale Cancellation Period
Where the statutory cancellation right applies to a distance sale of goods, the consumer will normally have 14 days after receiving the goods to notify us of their decision to cancel.
The consumer does not need to provide a reason for exercising the statutory cancellation right.
Different rules or exceptions may apply to certain contracts or goods.
Failure by a trader to provide the required information about cancellation rights can extend the statutory cancellation period, so Eco Tech Recycle should provide this information clearly for qualifying distance sales. GOV.UK
19. How to Cancel a Qualifying Distance Sale
Where statutory distance-sale cancellation rights apply, the consumer may notify us by a clear statement that they wish to cancel.

Suggested subject:
Distance Sale Cancellation – [Order Reference]
Please include enough information for us to identify the transaction.
Where required by law, an appropriate model cancellation form will also be made available.
20. Returning Goods After Distance-Sale Cancellation
Where a consumer exercises a statutory distance-sale cancellation right, the goods should be returned in accordance with the applicable legal requirements and the return instructions provided.
Where legally applicable, responsibility for the direct cost of returning cancelled goods will be communicated before the contract is completed.
Official government implementation guidance states that where the consumer is expected to pay the return cost following cancellation, this must be made clear in advance. GOV.UK
This section concerns change-of-mind cancellation rights and does not determine who bears return costs where goods are faulty, misdescribed or otherwise non-conforming.
21. Handling Goods During the Cancellation Period
A consumer exercising statutory distance-sale cancellation rights may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
Where legally permitted, a deduction may be made for diminished value caused by handling beyond what is necessary for that purpose.
We will not make deductions where they are not legally permitted.
22. Return Condition
Where possible, returned equipment should include the items supplied with it, such as:
charger;
cable;
adapter;
accessories; and
other components included in the transaction.
Customers should take reasonable care not to:
cause new physical damage;
remove components;
make unnecessary modifications;
add Activation Lock;
add Google FRP;
add Samsung Account restrictions;
add MDM;
add BIOS or firmware passwords; or
otherwise prevent reasonable inspection or testing.
The legal effect of any missing item, damage or handling will depend on the reason for return and applicable law.
23. Personal Data Before Return
Customers should back up any personal data they wish to retain before returning equipment.
Where reasonably possible, customers should also:
sign out of personal accounts;
remove personal SIM cards;
remove removable memory cards;
remove personal account locks; and
remove customer-added device-management restrictions.
Customers should not send us passwords, PINs, recovery codes or authentication credentials.
Where a device is returned because a fault prevents normal preparation, please contact us for instructions before attempting actions that could worsen the fault or affect evidence.
24. Data on Returned Devices
Returned equipment may need to be tested, reset, repaired or processed.
Customers should therefore ensure that important data is backed up before return wherever reasonably possible.
Eco Tech Recycle will handle personal data in accordance with its applicable Privacy Policy and Data Erasure & Data Security Policy.
Nothing in this section excludes liability where liability cannot lawfully be excluded.
25. Delivery Damage
If equipment supplied by Eco Tech Recycle arrives visibly damaged, the customer should contact us as soon as reasonably possible.
Where available, please retain and provide:
photographs of the outer packaging;
photographs of internal packaging;
shipping label;
photographs of the device;
description of the damage; and
delivery information.
Prompt notification can help us investigate the issue with the courier.
A customer’s statutory rights are not made conditional solely on the success of a courier claim.
26. Risk During Delivery to Consumers
Where applicable consumer law provides that risk remains with the trader until the goods come into the physical possession of the consumer or a person identified by the consumer, those statutory rules will apply.
The fact that Eco Tech Recycle may pursue a courier claim does not remove applicable consumer rights.
27. Refunds
Where a consumer is legally entitled to a refund, we will provide it in accordance with applicable law.
Under the Consumer Rights Act 2015, where the consumer is entitled to a refund under the relevant statutory remedy, it must be provided without undue delay and generally within 14 days from the point specified by the Act, using the same means of payment unless the consumer expressly agrees otherwise. Legislation.gov.uk
For statutory distance-sale cancellation, the Consumer Contracts Regulations contain separate reimbursement rules, including timing and reimbursement of the basic delivery amount where applicable. Legislation.gov.uk
Where no statutory refund right applies but Eco Tech Recycle agrees a discretionary refund, the specific agreed terms may apply.
28. Refund Method
Where required by law, refunds will normally be made using the same payment method used for the original transaction unless the customer expressly agrees otherwise.
We will not impose a refund fee where doing so is prohibited by law.
For a discretionary refund outside statutory rights, another method may be agreed with the customer.
29. Deductions
We will only make deductions from a consumer refund where permitted by applicable law.
Whether a deduction is permitted may depend on:
why the goods are being returned;
whether the return is a statutory cancellation;
whether the goods are faulty;
the extent of customer handling;
new damage;
missing components; and
other relevant circumstances.
A blanket deduction will not automatically be made simply because packaging has been opened or a device has been reasonably inspected.
30. Replacement Devices
Where a replacement is provided, its condition and specification will be communicated as appropriate.
A replacement may be:
the same model;
an equivalent specification; or
another solution agreed with the customer,
subject to applicable consumer rights and availability.
31. Repairs Under the Eco Tech Warranty
Where a repair is offered under our voluntary warranty, Eco Tech Recycle may repair the device itself or arrange an appropriate repair route.
Any warranty repair will be intended to address the covered functional issue.
The customer’s statutory rights remain unaffected.
32. Trade, Wholesale and Parts-Only Sales
Equipment sold specifically as:
trade;
wholesale;
spares;
parts;
repair required;
untested; or
otherwise subject to clearly stated limitations
may have different commercial terms.
Where the buyer is a consumer, such terminology does not remove statutory rights that cannot lawfully be excluded and should not be used to conceal material information.
Where the transaction is genuinely business-to-business, separate written commercial terms may apply.
33. Business-to-Business Sales
Where a purchaser is acting wholly or mainly for business purposes rather than as a consumer, the transaction may be governed by separate:
quotation terms;
invoice terms;
sales agreements;
warranty terms; or
negotiated conditions.
Consumer cancellation rights do not automatically apply to genuine business-to-business transactions.
Business customers should review the applicable quotation, invoice and written agreement before purchasing.
Applicable statutory rights and restrictions on exclusion of liability continue to apply according to the nature of the transaction. Government guidance notes that implied rights can also apply to business customers, although contractual treatment differs from consumer transactions. GOV.UK
34. Product Descriptions and Disclosed Faults
We aim to describe equipment accurately and disclose material known faults.
Customers should review:
listing or quotation;
photographs;
grading information;
specification;
fault notes;
accessories;
warranty information; and
any other relevant written description.
An internal device grade should not be treated as a substitute for the actual sales description.
35. Pricing Errors
We aim to ensure that prices are accurate.
If an obvious pricing or description error is identified before a contract has been validly concluded, we may correct it and invite the customer to proceed at the correct price.
Where a contract has already been concluded, the legal effect of an error will depend on the circumstances and applicable law.
Nothing in this section gives Eco Tech Recycle a general right to alter an agreed consumer price after a binding contract has been formed.
36. Complaints
If you are dissatisfied with a direct sale, warranty decision, return or refund, please contact:
Email: info@ecotechrecycle.co.uk
Suggested subject:
Complaint – Direct Sale / Warranty / Return
Complaints will be handled in accordance with our Complaints Policy.
Nothing in the complaints process prevents a consumer from exercising applicable statutory rights.
37. Relationship With Other Policies
Depending on the transaction, this Policy should be read together with:
Device Grading, Functional Condition & Resale Classification Policy;
Data Erasure & Data Security Policy;
Delivery, Shipping & Collection Policy;
Privacy Policy;
Complaints Policy; and
any specific invoice, quotation, product description or written sales agreement.
Where a specific written sales term lawfully applies to a transaction, it should be read together with this Policy.
Nothing in another Eco Tech Recycle policy overrides a statutory consumer right that cannot legally be excluded or restricted.
38. Changes to This Policy
We may update this Policy to reflect changes to:
our direct-sales processes;
warranty arrangements;
delivery and return processes;
applicable legislation;
regulatory guidance; or
business operations.
The latest version will be published on our website with an updated Last Updated date.
Changes will not retrospectively remove rights already acquired under an existing transaction where doing so would be unlawful.
39. Governing Law and Jurisdiction
This Policy and direct sales by Eco Tech Recycle are generally governed by the laws of England and Wales.
Where a customer is a consumer, nothing in this section deprives them of mandatory protections or jurisdictional rights available under applicable law.
